I agree it is wrong ...but let us look from the employer point of view ...mostly such employers are small companies trying to survive ...they have to balance 2 acts ..get a consultant and then find him a project soon..both are unknowns ..i.e. his consultant may get a h1 and then that person on h1 maybe smart enough to get a project ..it is difficult and these companies do serve a purpose i.e. they give entry in to US for many consultants ..who then jump after getting some experience.
The issue boils down to this:
Companies want to retain the employee as long as they can
consultant wants to leave as fast as they can
company wants to pay the least
consultant wants the most pay
Above four issues can be dealt with.
However; off of a project; company doesn't want to cancel h-1b (their investment, don't want to pay salary because it is cost prohibitive; many consultants want to go % basis as soon as they can and that is very little to pay people who are on bench). company tries to tell consultant to transfer h-1b or go back to home country and wait for new project. Consultant doesn't want to go back (they have their life here; kids going to school; car payments, friends, etc.).
It is a pretty easy solution from a company point of view; we don't pay bench but as soon as you are off project then you gotta go. People will beg and plead not to go; they will then try to transfer h-1b to another company without a job.

Does the original I 140 stays with the employer or employee? Any other document that I need to get from my employer before switching?

If you cant get a copy of everything (if you ask the attorney directly you should be able ot get a copy of the complete filing) try to get:
- copy of LC or atleast the section that describes the skills
- copy of employment verification letter which describes skills
original I-140 typically stays with employer. trhey might give youa copy of the approval notice...

Am in the same boat....485 submitted to NSC on July 2nd....140 pending in TSC. I called the Nebraska Service center at 1-800-375-5283, option 1-2-2-6-2-2-1 and the agent escalated my call ...then was told that if my I-140 was in Texas then the 485 will be tranaferred there. Its taking 6-8 weeks for receipt notices. On asking if transferring will take longer...she said no....will not take longer.

got receipt notice dated 6th of june for 140 premium processing and got call from employer on 8th of june evening saying the case has been approved. approved in less than 3 days.

My wife and i got emails from USCIS and we checked our status online and it is now CPO. The approval is based on my wife's applicatiion ( EB2 India, Dec 2005). I had two applications one as her dependent and another my own that is EB3 I, Jan 2004.

I am not sure why USCIS is publishing the updates every week saying that there is progress in receipting dates.
There are so many of us just in the July 3rd to July 16th range.
I don't get it. :confused:
