It is really sad to hear that. I am no expert by any means but assuming that you are still a young family (say in mid thirties), I would suggest that unless your family is financially secure and have other family members here in the USA to lean on, I will suggest to at least consider the option of going back, irrespective of what the outcome of you green card process may be.

In spite of massive lobby and muscles leveraged by the corporate sector, why do you think immigration bills - both pro legal and pro illegal - have been unsuccessful in the last two years ? Come on guys, by now you should not be questioning whether the public is against amnesty or even legal immigration. It is evident that the majority of citizens do not benefit from more immigration. Do you have an idea how much lobbying $ got involved on this without much success so far ? I am surprised that you are even raising this question. Why Americans should want more foreigners to compete with them when the real wages have declined ? That would defy logic.

Is this something that will be impacted by the Jul17th: no Labor substitution rule or are they completely different..
Retaining your PD, using a new I-140, is not the same as Labor substitution. There are several members who have successfully ported their PD, and may be able to advise you better.

Mehul- Very sorry to hear your situation. All our prayers and wishes are with you.
I am pretty sure you have investigated all options, but don't give up hope and most of all don't get beaten down. Keep the sprits up. A happy heart and mind can cure what medicines cannot.
When the going gets tough- the tough gets going.
Enjoy with your family. Do what is right by them. Wish you happyness & health.

Thank you all for your help and support but I have made peace with my fate. I have pancreas cancer with VERY poor pragnosis and trust me I took 5 different opinions with the some of the best hospitals in US and Europe.
Regarding my family, something is working out in Sweden and probably all of us will move there permanently in 1-2 months. We have some relatives living there.
Thanks again for all you help. You guys really made us feel we are not alone.

If your 140 Approved from NSC then you should get receipts from NSC. Not from TSC.

2012??? - According to the Mayan calendar the 2012 will bring the doomsday !!!! :D
I have been thinking in similar lines for quite sometime now. I have decided to wait till September 2012 to see if dates reach my PD which is October 2007.
If not i am strongly looking at New Zealand too...At least for me i want to work/live in a western country as locums and relax in India when i am off...I dont see myself working in India full time, at least not at this point.
This may not work for most folks but being in Health Care, i have this option.

Wanted to let everyone know of my experience. I dont physically have my card, but there is an approval notice on the USCIS website.
Priority date October 20th 2005
I opened a service request on Monday August 16th. The person on the other end of the line was extremely polite and nice. I told him I had a speaking engagement in Canada (which is the truth) and that if my case was expedited, I would not have to apply for a visa. He given me a SR number and asked me to wait for 30 days which I was prepared to do. However my case status changed online on August 19th. I am unsure as to whether this was because of the service request or things would have taken this route anyway.

Well, my old carcass is getting too aged to handle that anymore. So now I ease off the sauce and go to the gym.
But I do also try to notice and enjoy the silliness of the every day human condition. (Still to this day, I'm not sure why I mow my lawn, for instance.) A sense of humour is very important. Recognition that there are others less fortunate. And stay connected with friends socially.
And also recognize that fact that a green card won't make me magically happier beyond the immediate jubilation. Yes it is good to regain the rights we lost coming to the US. To speeches I'll still smile, nod, even clap and think "what a bunch of nonsense!" for privacy is the true freedom that you still have. But I'll still work for a living. I'll still put on a dress shirt to impress clients I'll never see. I'll still try to spend more time creating than managing. Not simply because my h1b legally requires me to do so, but because managing is intellectually trivial. Or one could say that managing is the work of man, creation is the work of the gods. ; )
